The OPGT may apply to become estate trustee of a person who has died in Ontario without a Will, without known heirs in the province or where the heirs are children under the age of majority.

As Estate Trustee, the OPGT must use the assets to pay the debts of the deceased, burial expenses and taxes. The rest of the estate is distributed to the beneficiaries according to the Will or, if there is no Will, pursuant to the Succession Law Reform Act.

The OPGT as estate trustee is responsible for ensuring that the blood relatives entitled by law receive the net proceeds of an intestate estate. The OPGT routinely searches for the heirs of deceased persons whose estates are administered by the OPGT.
