• In January 2003, MAG mailed out a consultation package on the regulation of contingency fees in legal matters to 96 interested stakeholders and posted the consultation materials on the MAG website.
• The purpose of the consultation was to identify options and issues regarding the implementation of a regulatory regime for contingency fees.
• MAG received 11 written responses in total.
• Based on the responses received, many of the issues are relatively uncontroversial. There is general agreement on assessment timelines; how to treat disbursements and GST; and the standard terms that should be included / omitted in any regulation.
• The key issue, where opinion is divided, is whether there should be a maximum percentage.
